These Terms and Conditions (“Terms”) govern your use of the Fringz Morocco online real estate platform (“Platform”), including its iOS and Android mobile applications (“Apps”). By accessing or using the Platform and/or Apps, you agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use the Platform and/or Apps.
1. Disclaimer of Liability:
Fringz Morocco (“Fringz”) is not responsible for any damage, whether financial, mental, or otherwise, arising out of or in any way connected with the use of the Platform and/or Apps.
2. Membership and Listings:
a. Buyers, sellers, agencies, and agents (“Users”) may purchase paid memberships to list real estate properties on the Platform.
b. Listings must be accurate and comply with all applicable laws and regulations.
c. Fringz reserves the right to remove any listings that violate these Terms or are deemed inappropriate at its sole discretion.
3. Membership Plans:
a. Membership plans may include various features and benefits such as increased visibility, enhanced listings, and access to additional resources.
b. Users are responsible for selecting the appropriate membership plan based on their needs.
c. Membership fees and any other amounts paid are non-refundable unless otherwise specified.
4. User Responsibilities:
a. Users are solely responsible for the content of their listings and any interactions with other Users.
b. Users must comply with all applicable laws and regulations when using the Platform and/or Apps.
c. Users agree not to engage in any unlawful or prohibited activities on the Platform and/or Apps.
5. Privacy:
a. Fringz respects the privacy of its Users and collects, uses, and protects personal information in accordance with its Privacy Policy.
b. By using the Platform and/or Apps, Users consent to the collection, use, and disclosure of their personal information as described in the Privacy Policy.
6. Intellectual Property:
a. The Platform, including its content, design, and functionality, is owned by Fringz and protected by intellectual property laws.
b. Users may not reproduce, distribute, or modify any part of the Platform without the prior written consent of Fringz.
7. Limitation of Liability:
a. Fringz shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Platform and/or Apps.
b. Users agree to indemnify and hold Fringz harmless from any claims, damages, or losses arising out of their use of the Platform and/or Apps.
8. Termination:
a. Fringz reserves the right to terminate or suspend Users’ access to the Platform and/or Apps at any time for any reason without prior notice.
b. Upon termination, Users must cease all use of the Platform and/or Apps and may lose access to their membership benefits.
9. Modifications:
a. Fringz reserves the right to modify or update these Terms at any time without prior notice.
b. Users are responsible for reviewing these Terms periodically for changes.
10. Governing Law:
a. These Terms shall be governed by and construed in accordance with the laws of Morocco.
b. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Morocco.
