These are the Fringz Terms of Use. These Terms of Use apply if you use any of Fringz’s websites or mobile applications. These Terms of Use inform you about your rights and obligations when you use the Fringz platform. Please read these carefully before using Fringz.

Wie is Fringz?

Fringz Morocco SARL (hereinafter: Fringz) is a company that brings together supply and demand of residential and commercial premises, purchase and rent, on its platform
that is available via mobile applications and websites such as Fringz.ma and the Fringz app (hereinafter: the Fringz platform). Fringz’s head office is located in Av. Moulay
Ismail, Rés. Volubilis Bloc C 1er étage N°53 in Tangier.

General

The use of the Fringz platform is subject to these Terms of Use, the Privacy Policy, the Cookie Policy and other additional regulatory documents that Fringz publishes on the
Fringz platform. If you do not agree with the content of these documents, you should not use Fringz.
Fringz reserves the right to unilaterally change these Terms of Use without prior notice. The changes will take effect immediately, unless otherwise stated. The announcement
is made by publication on the Fringz platform and/or by sending a communication by email to all Fringz account holders. You irrevocably accept these changes if you
continue to use the Fringz platform after the changes. We advise you to consult these Terms of Use regularly.

What do the Terms of Use apply to?

These Terms of Use apply to all agreements, all offers and all products and services of Fringz unless otherwise indicated. Deviations from these Terms of Use are only valid if
they have been expressly agreed with you in writing.
Your rights and obligations

As a user of the Fringz platform, you must act and behave in all respects as may be expected of a responsible and careful internet user. Among other things, you are not permitted to use (the content of) the Fringz platform for acts and/or behaviour that is contrary to the law, public order or morality.
More specifically, the following acts and/or behaviour are not permitted:
a.   infringe or otherwise act in violation of the intellectual property rights of Fringz and/or third parties;
b.   making infringing, unlawful or misleading statements;
c.   distributing material prohibited by law;
d.   circumvent, circumvent or remove the security of (parts of) the Fringz platform.

Intellectual

The Fringz platform and the material made available on it are protected by copyright. You are only allowed to download one copy of the material made available on the Fringz
platform for your own, non-commercial use. You are not permitted to reproduce, copy, modify, distribute, distribute, reverse engineer, decompile, frame, make available or
otherwise use and/or exploit the platform or the material made available on it without the prior written consent of Fringz.
It is not permitted to use Fringz’s word and figurative marks without the prior written consent of Fringz.
In the event that you do not comply with the foregoing, Fringz reserves the right to recover any damage resulting from this from you.

Material

By placing material (such as photos, texts, videos, floor plans, reviews, etc.), whether or not through the broker or advertiser, on the Fringz platform, you give Fringz permission
to use it for commercial and publicity purposes of Fringz. Some posted materials may be displayed through other distribution channels, such as websites not affiliated with
Fringz. By using Fringz’s services, you agree that your material may be displayed through these other distribution channels.
Fringz has the right to remove the material posted on the Fringz platform. See the section ‘Notice & Takedown Procedure’.
On the Fringz platform, functionalities can be offered, such as reviews. Fringz is not responsible for opinions and messages posted by users on the platform, and these opinions and messages do not reflect the views of Fringz.

Notice & Takedown Procedure

You may notify Fringz if you believe that any material on the Fringz Platform contains illegal or otherwise unlawful content. You do that through privacy@fringz.ma. In order to process your report, Fringz needs the following information from you:
1.   Your name and email address;
2.   An exact URL where the material is available and other information necessary for Fringz to identify the material in question;
3.   The reasons why you believe that the material in question contains unlawful content;
4.   A statement that you have submitted your report to Fringz in good faith and that your statements are accurate and complete.
You can submit the above information by email at privacy@fringz.ma. If your information is incomplete, Fringz will not be able to process your report.
As soon as we have received your (complete) report, you will receive a confirmation of receipt from Fringz. Fringz checks whether the report meets the requirements and, if necessary, asks you to supplement your report. Fringz will then review the material to which your report relates and inform you of the actions taken and the possibilities of
appeal in connection with the decision taken. If, after a careful assessment, Fringz believes that the material is manifestly unlawful and Fringz decides to remove the material or make it inaccessible, we will inform the data subject (e.g. the broker or advertiser) of this in a reasoned manner and at the latest at the time of taking measures.

How does Fringz handle your personal data?

In the Privacy Policy you can read what Fringz uses the personal data collected about you through the Fringz platform and how you can exercise your rights with regard to this data. You can find more information about the cookies used by Fringz in the Cookie
Policy.

Liability and indemnification

Fringz is not liable for any damage suffered as a result of the use of the Fringz platform or websites to which the Fringz platform links. Furthermore, Fringz is not liable for damages, arising from or in connection with the use or inability thereof, of material available on the Fringz Platform. Fringz is not liable for damage as a result of the use of services and/or information of third parties, which are offered via the Fringz platform. Furthermore, Fringz is not liable for damage resulting from the use of electronic means for communication with its platform, including – but not limited to – damage resulting from non-delivery or delay in the delivery of electronic messages, interception or manipulation of electronic messages by third parties or by software/equipment used for electronic communication and transmission of viruses. Fringz does not guarantee that the information and material provided on the Fringz platform is up-to-date, complete and/or accurate. Fringz also does not guarantee that the information provided on the Fringz platform is free of errors, defects and/or viruses. Furthermore, Fringz does not guarantee that such errors and/or defects in the Fringz platform will be corrected or viruses will be remedied.
In case of doubt about the correctness of the information or if inaccuracies are detected, we advise you to contact the person who offers the information in question (usually the selling agent). Fringz is not liable for damage that arises directly or indirectly from the use of the information you derive from Fringz.
You indemnify Fringz against all claims by third parties for damage they have suffered or claim to have suffered as a result of:
a.   the use of information on the Fringz platform that has been placed by you or by (legal) persons acting on your behalf;
b.   removing or disabling access to material as a result of your NTD notification; or
c.   which are otherwise related to or arising out of your use of the Frin gz Platform.

Which law applies to these Terms of Use?

These Terms of Use are governed by Moroccan law. Any dispute regarding these Terms of Use or your use of the Fringz platform will be submitted to the competent court in
Tangier.
